Here's the deal. Went through my Better Business Bureau arbitration hearing for the lemon law case I have on my '02 Z last Tuesday. In the hearing the GM rep consistently threw his local dealer Poway Chevrolet, under the bus. GM informed me that the warranty paint concerns that the dealer did on my car were not covered by GM under warranty because the dealer did not acquire the proper prior consent before beginning the task.
Keep in mind that my car spent 39 days in the shop, 36 of which were for warranty paint concerns. The dealer repainted the entire vehicle after they could not match the paint on the bumpers and did an Earl Schieb job on the car. I took it to a professional body shop for an estimate as to mow much it would cost to repair the damage done by the dealer and also what kind of hit they thought I had taken on the resale value of the car with the dealer repaint the way it was. The estimate... $10 grand for a new paint job, 6 weeks in the shop, and an estimated $10 grand hit on resale value.
GM took the position that although the dealer told me the car would be covered under warranty, and they did not charge me for the repairs, the dealer absorbed the cost of the repairs because they did not acquire the proper authorization from GM, and that, although GM was sorry for this happening, they did not believe that it was their fault that the car spent the time in the shop and now qualifies as a lemon. They put the blame entirely on the dealer for what happened. They said that just because the dealer is an authorized GM service center, doesn't mean that the problems you bring your car in for under warranty will be covered under warranty, even if the dealer tells you they are and does not charge you for them.
This is all on tape and will be submitted at the court hearing if I have to file a lawsuit.
So, be aware, you not only have a manufacturer's warranty, but you also have a dealer's warranty. I would make it a point to know which warranty your repairs will be covered under the next time you bring your car in for service, so you don't wind up in the same situation as I am in right now.

I had really hoped that GM would step up to the plate on this and take the car back, but they are fighting it every step of the way. I will win, but I have to jump through hoops to do it. Sorry to hear that oyu had to have yours replaced. I hope you are much happier with your '02.
Stick with it.GM will try to break your will.In most cases they will drag it out so you will break down.I had a couple of friends lemon their F-bodies and won.

Customer service is a thing of the past with them........
The FIRST priority should be take WHATEVER steps neccessary to get YOU happy, and then work out the details with the authorized dealer..........after you are out of the picture.....
What the dealer said or did to/about you, is on no consequence.........
You are the innocent injured party........period.
GM you suck..............

Those were my thoughts too. For GM not to back the dealer like that, especially in a recorder hearing is BS. The dealer made a call and stuck by it. Now it is GM's responsibility to back their vehicle, especially if the repairs done to it were done under warranty.
I get my decision from the BBB tomorrow. If haven't involved my attorney yet, but if I have to he is going to have a field day with this one.
Just got my decision from the BBB. I won, but they aren't giving me enough to be able to stay in the vehicle, so now I will have to sue GM. At least this decision is admissable in court.
Wow, sorry to hear of your trials!! Stuff like this is so draining, and it really makes you leary of "believing in the system"! I guess I can see GM's point, but.....? I dunno... Best of luck!!
Do you have any recourse with the dealership for damages?
Funny thing about the numbers. Just got off the phone with my CU and they said I would only need to put $6K down on a new Z to get my payments where they are now. If I did a repurchase GM would owe me $10.5K + payoff on the car. Arbitrator left the decision up to me. I have to see what the attorney says before I go any further with this.
