Looking for a good labor attorney

Is anyone on the board, or does anyone on the board know a good labor attorney. I need to talk to someone about some unethical hiring/firing practices that I have been put through in the last few weeks.

Mark I work with about 10 different law firms and private lawyers here in NY, but unsure if they would have jurisdiction in RI.......I will ask for you though and let you know.....whatever the issue is, I'm sorry you have to go through it - hang tough

I'll send an email to the other attorneys at my firm. We have one guy at our Boston office and he may know someone in RI that does employment litigation. I also think one of the partners in our NY office may be admitted in RI.

The story is pretty simple, I was interviewed and hired 5 weeks ago to be the Director of Education Services for a startup company. All through the interviewing process with the VP of Global Services and the CEO I am constantly told how important this position is to the success of the company.

I am also told that the company is currently looking for its next round of financing. So they hire me and I spend 5 weeks busting my ass getting things started for them. They close the round of financing with the original venture capital firms for $10m, and the term sheet for this round is pretty aggressive. The company is told to cut its burn rate from $1 million per month to $770K per month.

So, as part of the cuts I am told that I am part of the Reduction in Force.

Today, the new CEO (the original CEO left when the VC's said they wanted to get the company sold right now) offers me 3 weeks severance. When I tell his admin, who is the one delivering this message to me, that I think this offer is unacceptable, her statement is that maybe I need to speak directly to the CEO and the companies counsel.

Now, I am not looking to win the lottery here, but this smacks of unethical behavior, at the least. To spend so much time telling me how important this postition is to the company and then have it cut out from under me after only 5 weeks, ,especially when I left a stable job to take this one, just gets my goat.

In every similar situation involving a Director level person that I have been involved in, the Director was given 3 to 9 months severance. I told the HR guy tonight that I thought 6 months was a fair settlement, and he was going to float this by some of the folks, so we will see.

I just want to be made whole here, I do not think it unreasonable to have expected at least 6 months of work out of this company after the way they positioned the job and its importance.

Am I completely out to lunch here legally, do I have a leg to stand on?

Sorry bout he situation, Mark. I think you have a case, but the spent spent vs. money gained in addition to the mental hassle of the court proceedings.....I don't know what kind of money to fight this or how much money 3 months severance is for you, but unfortunately that is the bottm line. Good luck!!! (Yet ANOTHER reason I choose to be self employed)

Talked to a couple of folks, I have no real claim, it sucks, but the lesson learned here is that when you are negoitiating for a high end position, megotiate a termination agreement as well.

Several irons in the fire right now, I think something will pop as early as next week.

Sorry to hear hear about the raw deal you got Mark. Keep your head up though buddy. Your better off finding out right away what scum they were.
I know it puts you in a tight spot, but, things find a way of working out. Especially for good guys like you, hang in there bro.
