accidents suck...

So I had an accident in the F150 at 6:30 this morning. Not too bad, just a fender bender with no injuries. Unfortunately, I think the guy that I had the accident with is fibbing and now I'm being told (By my insurance Co.) the accident was probably my fault because I was at a stop sign.

Heres the details, what are your thoughts...

After filling up my gas tank, I was heading West on 121 through The Colony. I pulled into the turn around so that I could go East on 121 (You can't go west from the gas station due to a median) I waited for a bunch of traffic to pass and saw an opening with about a 150 to 200 foot gap in the left lane of the road. The car passes and I pull out. I was about 3/4 straightened out and BLAMMO we hit. he pulled off to the right a little ways up, I pulled immediately off to the left.

He says that he was in the left lane and that he swerved to miss me, but he also said that he had a car in the right lane that was next to him.

What I'm wondering is where did he swerve to? If he was in the left lane how did I get 3/4 straightened out before we impacted, and why is it that the back of his Driver side wheel well, catch my bumper?

I'm thinking that he was either changing lanes when I entered the highway or he was not paying attention/falling sleep at the wheel and drifted.

I dunno, I guess I should just be grateful that no one was hurt. Still though, It sucks when you have an accident any your told "Well, its your fault for sure!" by your own insurance co.

Looks like I'm gonna have to suck it up and take the hit for it.

Don't look good, regardless of the other vehicles actions. Most states have phrases in the laws that read something like
" and shall proceed only after yielding the right of way to all traffic on the intersecting street which is so close as to constitute an immediate hazard."

One of the most common things we hear(police) is the other vehicle "must have been speeding", but even then you would have to show proof of speed and good reason why you pulled out in front of a speeding vehicle if visibility was not a factor. (Not saying that's the case here)That is usually hard to do.
The contact you describe may be consistant with the other vehicle's evasive actions in the eyes of an insurance investigator.

The vehicle entering an intersection has most of the responsibility in almost all cases. There are few exceptions.

It's a minor accident. Don't lose too much sleep over it. Stuff happens.

Okay well I had some time to calm down a bit about it. And the final verdict.... Meh. It was a fender bender I'm over it. For the most part I am just glad everyone was able to walk away from it without injuries and only some minor damage to thier vehicles.


I am taking it to the body shop tomorrow and getting her all fixed up. After that, I am putting a for sale sign on it. I just got a contract on my investment property and as long as we can get it closed, we are FINALLY going to get my Z06.

See that... For every dark cloud...

Well here is more to the silver lining:

We got a contract today on the investment property that has been holding us up for what seems like an eternity. We should be closing by mid Feb. As long as we can close (I don't forsee any problems) and I can get the F150 sold I will be driving a Z in the next 30 to 45 days.

Other silver linings? Yup...

Dropped off the truck at the bodyshop. Will be there until next friday. Bumper, 2 fenders and a mirror replacement. No sub damage as far as we can see.

Got my rental car. Volvo S40 for 6 bucks a day! Not too shabby. Now as long as my rates don't skyrocket too bad I should be good to go!!

Performin Norman you are an insurance guy... I havent had an accident in over 12 yrs... any idea what the average is for a situation like mine

Well for the longest time I have been saying I wasnt going to worr about the color, but I have always been a fan of Black, and If I am going to do this I am not going to sell myself short.
