Ok as im sure a few of you know i had 2300 bucks worth of stuff out of my apartment by my roomates friend while im sleeping. This is the Thread on that Ok i seriously feel like killing someone ...
So i guess the friend has stated he didn't Steal anything So It boils down to this. I am wondering if i have a civil case against my roomate ? My laptop on my was on my coffey tabel when i went to bed at 2am. He left at 5 am and my roomated did not walk him out and lock the door behind him. So it was unlocked from 5 am till when i left for work at 10. The Police officer said that it was her responsibilty to lock the door behind her friend ??
So instead of spending 100 bucks to talk to a lawer i thought i would ask you guys. Do i have a civil Case against my now x roomated ???

Unfortunatly you need alot more. If the door was unlocked it could have been anybody, though it probably was between you x-roommate and her friend, probably hder friend. One thing thats comes to mind is that it costs roughly $1500 to replace a tooth... Just multiply that by 4 or 5 teeth.

One thing thats comes to mind is that it costs roughly $1500 to replace a tooth... Just multiply that by 4 or 5 teeth.
And when the roommate's friend has you arrested for assault, the $1500 multiplied by 4 or 5 will be just about the restitution you'll pay to avoid going to jail!
Why haven't the police gotten her friends name and info? Where is he? can you find him? In civil court you only have to prove preponderance of your claim which is 51% not "beyond shadow of doubt" like you would in Criminal Court. You should be able to win your case based upon the aforementioned facts, albeit circumstantial evidence. The problem arises' in the form of making her pay, civil judgment's are orders to pay. I'm not aware of a mechanism that can force her to pay such as garnishment in this type of scenario. OJ aint payed one cent.
