I ordered a Roll Cage from TByrne Motorsports about 2 weeks ago and it appears they will be back ordered for longer then anyone expected. I decided to go ahead and cancel my order and have a local shop do a custom install. Tbyrne says it will cost $100 to cancel my order despite the backorder and delay. Would you:
1) Pay the $100, move on and get it installed this week.
2) Wait for a month(hopefully) to get the cage and try and sell it and miss out on some events planned.
3) Try and discuss the issue with Tbyrne manager.
4)Other
They told me I have 24 hrs. to decide.

Cancel and go to Neverlift. Rob, I saw my roll cage about 60% done last Wednesday and he's done a GREAT job so far. No mail-order kit is gonna look like a custom job. It's well worth it.

Questions...
1. Did you sign the order?
2. Do you have a copy of the order?
3. Does the fine print specify the $100 charge if you cancel?
If it says in writing that you have to pay the Benjamin, and you signed then you are obligated. Or, if it's posted where you can read it, like in the office, counter area where you order. Shops who have to order items like roll cages that are heavy, and costly to ship, have to have some sort of protection against cancels, cause they have to ship it back and usually have to pay the manufacturer's stocking fee. $100 might sound high but when you add shipping both ways and fees it adds up.
That $100 cancelling fee is BSHIT.

I thought a business would be smarter than that, knowing you would be back for business if they treat you right. Obviously if you pay that 100 you wont buy from them again and they lose out in the long run.
I understand the shipping issue but it has not been shipped yet anywhere. I will contact them in the morning and see if I can get past the receptionist on the phone who says its their policy and that all. I can understand that they have policies in place to prevent from them having to eat alot of costs they may acquire due to cancellations, but I would gladly pay 10-20 bucks for the hassle not $100. I feel their making money off of me because I changed my order due to their inability to provide me with a product they advertise in a reasonable amount of time. They had no problem running my credit card however. I will see how this turns out but I think all should be aware of the policy that Tbyrne subjects his customers to.
Since the roll cage(a non specialty item) has not even been available by wolfe yet, Im only responsible for a processing fee of $100.
If the roll cage had been shipped already and I wanted to return it, I would be responsible for $200 restocking fees PLUS shipping fees. Just stating what I've been told by their customer service and don't want others to be trapped by their policy if they choose to purchase an item and wish to return it for any reason. I'll keep you posted.

No, he is NOT smarter than that. I don't think he stocks a fricking thing, just so they can collect this crap. I had ordered a cam and headers from him and got this "back order" crap. I gave him two extra weeks and told him I needed to get that stuff by then so I could be ready in time for the 50th Cruise. The deadline came, spoke to Tom and he would not waive it. I told him I'd cost him at least that in business, and I think I'm over it several times by now.
It takes all my willpower not to post something in every one of his threads about this back-order crap. I think he must spindle orders until he gets enough to get a quantity break. If someone backs out, he pockets the $100 and everyone else gets to wait a while longer.
Tom, sure hope that $100 is worth it to you pal!

robz.....my bad. If the cage has not even been ordered yet that is total bullcrap. Sounds like to me he backorders a lot of things and throws the $100 up so he can make extra cash. No way to do business IMO. I wont deal with him. Thanks for the info and warning on this guy. I am sorry you are having to go through this. If people would just treat people they way they would want to be treated themselves we would be a lot better off. What a novel idea, sounds like the Golden Rule to me.
Rob, this is just my own personal opinion but I would talk to Tom at TByrne personally. I would explain to him that the only reason that you are requesting an order cancellation is due to the fact that the expected delivery/receive date has been pushed back much farther than either of you anticipated.
I understand the reasoning behind some type of charge for cancelling an order under normal circumstances. A company has to set a policy to cover their stocking/restocking costs and the cash flow position of a company requires that there is some recompense for cancelled items after they have submitted the order to the manufacturer. That's just the nature of business, especially small business with limited cash flow reserves.
Your situation, as you described it, would appear to be something other than normal circumstances and I think a nice talk with Tom might get this situation resolved in a manner to your satisfaction.
As I said, that's just my own personal opinion and does not represent the Z06Vette site.
You mentioned that you charged it on a credit card. You can go back to the credit card company and disallow the charge because the merchandise hasn't been delivered. Be sure and tell them that you are attempting to get the charge reversed with the merchant but he is uncooperative.
