I do not know how Texas works but in California you can...

usually have a trial by declaration (you can write your statement down and the police officer does too and the traffic court judge will look over statements and decide on that) which would be nice so you dont have to waste a lot of money to get to court to fight it.

I say it would be a waste on your part to go to Texas to fight it. If that is your option just plead no contest and pay the fine if they have online traffic school take that to avoid the points.

I would venture to say that more than likely he did not have you on his radar or was not able to lock the radar onto your speed. It was probably your exhaust which made him think you were going faster than you really were. You could probably fight this ticket and win (I know you would win for sure if you were in CA) Due to the reasonable doubt that you may have slowed the 20mph lower than the posted speed limit.

If the fine is up to 200 dollars I am sure you would not get hit with that for this. Usually they knock down the price of fines if you plea.

Mark - I wish you teh best with this situation. Obviously, going back to court does not seem like an option, bit, I am sure you MUST APPEAR is you contest NOT GUILTY.

Happened to me in Missouri about 10 years ago. Except, the jackass tol dme I could plead NOT GUYILTY by mail and low and behold, when I got back to Arizona, the "fine print" said that ONLY A PLEA OF GUILTY CAN BE MAILED IN. So, I was assed out, just like you are now. Your ticket is a bit on teh steep side, no doubt, especially when you say you DID slow down. I guess his radar gun is always on, and is recorded or something because I don't see how he knew your speed when he was outside his vehicle.

I got my day in court on the 13th for parking half up a sidewalk. I am going to plead that BOLO CONDENTERE or whetever it was.....

But, on the positive side, New York does NOT accept any outside the state tickets unless it is drugs or dui related.

NOt sure what it is called, but they do not honor any tickets given external to New York State for New York residents with a NY license.

Does your home state have this law ? If not does that give you any wiggle room ? Many states do have this move over law now .. And tho it's always safest to move over to the next lane,it not always possible and in your case you slowed to being only 5mph over the specified minimum,which seems to comply with the spirit of the law if not the letter. Groan ..... Just another revenue stream for "the state".
If this impacts insurance rates,it might be incentive to retain some legal assistance .. if rates are unaffected .. 300 clams is probably as cheap as it gets .. The whole thing doeth suck for sure ..

Wisconsin has the same law. And they have no sense of humor about this at all.
My significant other got it last month. I am leaving the MKE area on Tuesday going through Texas on My way to PHX How are the troopers along that route?

Starting about 50-60 miles east of Fort Stockton, TX on I-10 they start to increase in frequency all the way to El Paso.

The speed limit goes to 80 mph during the day here, but do not stray to far over that number...

Radar detector is a must.
