I believe they have to refund the money.
I ordered a 2000 Black Coupe from a dealer and had a bad experience with sales manager upon the cars arrival. I went and ordered a Z06 from another dealer. I demanded my $1000 deposit back from the first dealer and received it with no questions asked. The Black Coupe was sold the next day.

Do you already have a TPW (Target Production Week) on the Kerbeck car? 'Cause if not, then it'll be easier to get out of the agreement.



I had a yellow Z06 on order at a local dealership, and I had very little confidence in them being able to get the yellow. Since THEY had little confidence also, and when I located a yellow one through a vendor on the Corvette Forum, it made it a lot easier to tell them that I couldn't tie up my deposit any longer.



Like most others said here, they WILL sell your car when it comes in, so THAT shouldn't be an issue. Just don't let 'em screw you down there in A.C...

dear frank , and everybody watching

I HAVE A Z06 ORDERED AT KERBECK DUE LATE MARCH WITH MY DEPOSIT.!!!

LAST NIGHT I PICKED UP A Z06 FROM MY LOCAL CHEVY GUY 250.00 OFF LIST AND DROVE IT HOME... NEEDLESS TO SAY I AM THRILLED WHAT DO I TELL KERBECK?? I DONT WANT TO LOOSE MY DEPOSIT...

Bullet,

Congrats on the new Z. Hopefully if they sell the car right away they will be honorable and return your deposit. Don't tell them about the new Z. Put the word out that there is going to be a Z06 available.

As far as I know they have to return your deposit. Take your contract to a lawyer and have him give an opinion. I did when they did not want to honor the price that was on the contract due to their error. Good Luck, and I agree with Frank, don't tell them about the other Z.

Kwik story:

Years ago, put a $100 deposit when I ordered a new Chevette. After waiting weeks and weeks with no car, found a nice Chevette at another dealer and bought it. First dealer pointed to fine print on back of sales agreement and it allowed them to keep my deposit...lesson learned--put down the absolute minimum amount as a deposit.

Welcome to the forum. They have to return your deposit, unless you signed a deal that was non-refundable. As a courtesy, you may try to move it (as it appears you are) for them. They WILL sell it, but the salesguy you worked with may not, so he is the one who gets screwed.

I had a similar situation back in August, the car was on order since May and I had a deal on one locally right here. I took the local deal, but let the other salesguy sit on my "sold" order until he sold the car to someone else. He then credited my card. He got his sale, I got my deposit back.

Once you cancel the order, all the other salespeople can now grab it up. Be upfront with your sales person, and you might get a pleasant suprise. I realize dealers are often dishonest with customers, but that stuff works both ways.

They might start getting a little more picky about the deposit refunds. If I understand the letter from chevrolet to the dealers correctly, if the name on the order doesn't match the person purchasing the car the dealer loses an allocation. I would assume this is to keep dealers from putting in bogus orders so they can get cars on the lot. Also remember how your actions effect the other people waiting on their cars.

Whether or not you have a right to get your deposit back all depends on the contract you signed. If it says nothing about being non refundable, for all intents and purposes, you should be able to get your deposit back. Even if it does say that your deposit is non refundable, you may still be able to get it back, but explaining that would take up too much space, and then I would have to charge you.
